Jeffrey Pollock appeared before the Selectmen Tuesday, May 27 to propose a possible amendment to the Class 2 Used Car Dealership License Agreement now held by Bieren’s Garage at 50 Concord Road. The current license allows for a towing company with up to three cars on display at the front and up to 15 cars held in the rear. Pollock is seeking an amendment that would allow up to two towing vehicles with 15 cars stored in the front and 100 behind the building.
Code Enforcement Director Chris Laskey reviewed the history of the business in a memo to Pollock: “There is an extensive history with this property including complaints, zoning decisions and court orders; primarily due to the fact that this is a commercial use in a residential district.” He went on to write, “It was agreed by the town to allow no more than two towing vehicles and no more than three (3) vehicles for sale and the storage of no more than fifteen (15) vehicles related to the towing company in the rear of the property.” Laskey said in his opinion the proposed use of 15 cars in front and 100 in the rear fits the category of a vehicle dealership, which is not allowed in a Residential B District. He went on to say that the property is considered preexisting and non-conforming and Section 7.1.2 of the zoning by-law that deals with changes to nonconforming use would apply.
Selectmen Chair Mark Siegenthaler told Pollock that to change the agreement he should first seek a ruling from the Zoning Board of Appeals. If their ruling was in the affirmative, the next step would be to come before the Selectmen for a permit. He pointed out that the application to the ZBA would have to come from the property owner.
