Public Hearing: Land Uses Related to Non-Medical Marijuana

September 20, 2017

Submitted by the Bedford Planning Board

On September 26, 2017, the Planning Board will hold a public hearing on the topic of land uses related to non-medical marijuana. Such uses were legalized in Massachusetts through a ballot initiative in November 2016 and the legal framework for their regulation was amended by the state legislature in July 2017.

Bedford’s Zoning Bylaw currently allows (only) medical Registered Marijuana Dispensaries in the Industrial C District, subject to satisfying a range of conditions. As a town where the majority of voters were opposed to the state ballot question on non-medical marijuana, Bedford has the option of prohibiting wider marijuana-related uses through its normal decision-making channels. There are zoning and non-zoning aspects to the Town’s decisions, which will be made by Town Meeting. This public hearing is to consider two approaches under zoning: either a) a prohibition or b) a temporary moratorium to allow the subject to be studied.
